The following rules are of a general nature only. To the extent not covered by this statement, the provisions of the SCHMITH POLSKA S.A. Terms and Conditions of Claims shall apply and shall be consulted: https://schmith24.pl/obsluga-reklamacji.
Requirement to comply with operating and safety rules: In any case, the operation of the goods and/or equipment in accordance with the guidelines contained in the documentation or description of such product is required to maintain the warranty rights. It shall be ensured that the supplied SCHMITH POLSKA S.A. brand products ("Products") comply with the requirements for approval.
Limited warranty period:. SCHMITH POLSKA S.A. gives a 12 month guarantee on the offered Products, starting from the date of sale. This does not exclude a separate warranty for a different period (longer or shorter) - which will be specified in the documents attached to the goods or in their description or in the commercial contract concluded with SCHMITH POLSKA S.A.
The guarantee does not cover:
a. Normal wear and tear parts, consumables (filters, seals, V-belts, light bulbs, fuses, bearings, etc.),
b. Damage not attributable to SCHMITH POLAND S.A. and defects in the equipment resulting from other causes than those inherent in the Product,
c. Damage to the Product resulting from environmental influences, improper transport, storage,
d. Damage and defects including, but not limited to, mechanical, resulting from improper handling and operation of the product or handling or operation not in accordance with the documentation or safety requirements,
e. Products whose assembly/service was not carried out by SCHMITH POLSKA S.A. or was carried out under conditions which do not comply with the documentation or safety requirements,
f. Products whose commissioning has not been carried out and documented in the Warranty Card by service or by persons with the appropriate qualifications and experience,
g. Products in which modifications have been made, operating parameters have been changed, equipment parts have been repaired or replaced without the written consent of SCHMITH POLSKA S.A.,
h. Damage and defects in the housing and components not resulting from the goods, which do not affect the functionality and correct operation of the equipment,
i. Damage and defects resulting from liquids or dust or surges in the electrical network, etc.
j. Other defects not inherent in the product/goods - damage and defects not lying in the goods themselves;
Limitations of Guarantee / Liability: The warranty / liability of Schmith Polska S.A. does not cover: the economic suitability or the commercial value of the purchased goods, and also excludes: liability for consequential damages, for damages caused by downtime of the equipment during the period of waiting for warranty services and any damages to property other than the equipment / goods covered by the warranty, as well as to any other property of the customer, damages to property and personal injuries and other unmentioned consequential damages, which are excluded from the liability of Schmith Polska S.A.
The warranty does not include the obligation to process incomplete or untimely applications where Schmith Polska S.A. for orders in the B2B model, reserves the right to refuse warranty service. The aforementioned may also occur in the event that the customer unreasonably withholds payment for goods or equipment or for previous service, as long as such payment was due.
General terms: In the case of complaints regarding quality, delivery, non-compliance with the invoice of the Products, they must be submitted immediately and in accordance with the applicable regulations, together with a detailed description of the subject of the complaint. The deadline for notification is: 5 working days from the moment of delivery or other time specified in the product-specific card. In the case of defects inherent in the product but not discernible upon receipt/collection of the goods, the period during which such a defect may be reported is up to 12 months from the date of purchase, but such a defect should be reported immediately upon its discovery with simultaneous exclusion of the defective goods from further operation/use;
The complaint will be considered within 14 days of receipt by SCHMITH POLAND S.A. of a correct and complete complaint notification. In any case, the complaint must contain appropriate documentation justifying and confirming the defect claimed and indicate the proof of purchase. If the defect is not reported immediately upon delivery, i.e. within 5 days after delivery, the right to report such a defect is not entitled. SCHMITH POLSKA S.A. may also disregard a notice of defects if the quantity has been confirmed on the relevant delivery note.
Exclusive warranty and other applicable rules: In non-consumer relations, the warranty to the full extent is excluded. SCHMITH POLSKA S.A. shall be the sole guarantor for the goods supplied by SCHMITH POLSKA and which are not SCHMITH POLSKA S.A. products. SCHMITH POLSKA S.A. shall retain title to the goods until full payment for the goods supplied has been made.
